                   	     ORDINANCE NO. 9730
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING KING STREET
                   LOCATED NORTHEAST FROM M.L. KING BOULEVARD,
                   BETWEEN HOUSTON STREET AND MABEL STREET, MORE
                   PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN
                   CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned King Street located northeast from M.L. King
         Boulevard, between Houston Street and Mabel Street, more
         particularly described herein, and as shown on plat attached
         hereto and made a part hereof by reference:
                King Street, a 16 foot wide right-of-way beginning
                on the northeast line of M.L. King Boulevard (as
                now widened) 192 feet southeast of the intersection
                of the northeast line of M.L. King Boulevard (as
                now widened) with the southeast line of Houston
                Street, and extending northeast 495 feet between
                parallel lines to the southwest line of East 8th
                Street.  Said Street separates lots A, C, E, and G,
                block 5, from lots B, D, F, and H, block 5,
                Griffin's Addition to Chattanooga, Original Town,
                not recorded.  Tax Map No. 145D-U-1-3, 8, 10, 11,
                and 14.
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
                1. The City of Chattanooga has a sewer located
                   within said right-of-way and reserves an
                   easement the width of the right-of-way for the
                   purpose of maintaining said sewer, provided that
                   upon completion and acceptance of a replacement
                   sewer, said easement shall be deemed abandoned.
               
                2. The areas reserved for the sewer easement must
                   be kept free and clear of all structures until
                   said easement is abandoned.
               
                3. All existing easements are retained.
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
